A rioter who was photographed brandishing Nancy Pelosi’s banner is now being held responsible for a tragic Missouri collision.

According to officials and her lawyer, a Missouri woman seen on television clutching a shattered sign from House Speaker Nancy Pelosi’s office during the U.S. Capitol riot is suspected of causing an accident Wednesday that killed one person and critically wounded another.

Emily Hernandez, 22, faces two counts connected to driving while drunk and causing an accident that resulted in death or significant bodily harm, according to a Missouri Highway Patrol arrest record. According to the article, she was also suspected of having an elevated blood alcohol concentration.

Hernandez was discharged from a local hospital after suffering a major head injury, according to her lawyer, Ethan Corlija, and was not brought into arrest. It wasn’t evident why right away.

A spokeswoman for the Missouri Highway Patrol did not reply to a request for comment on Thursday. Neither did the prosecutor in charge of Hernandez’s case.

Hernandez was driving a Volkswagen sedan westbound in the eastbound lanes of Interstate 44, roughly an hour southwest of St. Louis, according to a collision report. She swerved to avoid colliding with an incoming SUV, which swerved as well. According to the report, their cars collided, and the SUV hit the median.

A 32-year-old woman in the SUV was confirmed dead at the scene, according to the report. With significant injuries, a 36-year-old man was taken to the hospital. His health status was unclear.

Hernandez was doing this when the collision happened, but Corlija refused to reveal what he was doing at the time. He stated he believed officials when they indicated she was driving the wrong way and that there was no proof she was inebriated.
